What is the minimum wage?
Employees posted to Austria to perform work are entitled to at least the amount of remuneration that is due them in Austria pursuant to a statute, ordinance or collective agreement; this amount includes special payments, overtime and other supplements as well as allowances.

Temporary agency workers assigned to Austria are entitled to the amount of remuneration that is stipulated in the collective agreement for the user undertaking’s business in Austria or in the collective agreement for temporary agency work; this amount includes special payments, overtime and other supplements as well as allowances.
Consideration may also have to be given to other general provisions with legally binding effect (such as works agreements) which apply to comparable employees performing comparable work at the user undertaking.

Undertakings that post or hire out workers to Austria are obligated to pay at least the minimum wage applicable in Austria.
The minimum wage level in the specific case is not defined by law in Austria but usually derives from the collective agreement applicable to the sector and type of work.
Paying wages below the minimum level entails heavy fines in Austria. Apart from any such fines, employees can bring court action to claim the difference.
It is therefore particularly important, prior to posting or placing workers, to be aware of the minimum wage levels stipulated in the applicable Austrian collective agreement.
